Terms of Use

1. Agreement
Review of the following terms and conditions before use of this website is advised. This document is a legally-binding instrument (“Agreement”) between the user and Magic Lawyers (“Magic Lawyers”). This Agreement deals with the user’s use of Magic Lawyer’s website and any related non-legal services (collectively “Website”).
In consideration of the user’s use paid services of Magic Lawyers, the user represents that they are competent to contract under the laws of the applicable jurisdiction. The user also agrees to provide true accurate, current and complete information about them as prompted by the Website’s subscription form, if they wish to subscribe to use Magic Lawyers’ services. The user’s continued participation on this Website indicates the user’s acceptance of these Terms and Conditions, including the user’s acceptance of the Privacy Policy and of the collection, use, disclosure, management and storage of the user’s Personal Information (as defined in the Privacy Policy).
If the user has any objections to any of these Terms and Conditions, the user should immediately discontinue use of the Website.

2. Amendments
Magic Lawyers may, at any time and without notice (explicit or implicit), revise this Agreement or the Privacy Policy by posting an amended version on the Website. Changes made to either the Agreement, or the Privacy Policy, or both will be effective immediately upon posting on the Website. It is the user’s responsibility to periodically review this Agreement and the Privacy Policy. Unless express consent of the user is availed by Magic Lawyers for retrospective effect, the amended Agreement and Privacy Policy will have a prospective effect on use of the Website and the information collected by Magic Lawyers. Magic Lawyers retains the right to modify or discontinue the Website, at any time and without notice. The user agrees to Magic Lawyers having no obligation with regards to modification or discontinuance of the Website.

3. Informational Purposes Only
Content contained on or made available through the Website is not intended to and does not constitute legal advice and no attorney-client relationship is formed, nor is anything submitted to this Website treated as confidential. The accuracy, completeness, adequacy or currency of the content is neither warranted nor guaranteed. The use of information on the Website or materials linked from the Website is at the user’s own risk. Neither Magic Lawyers nor the Website is a lawyer referral service and the content on this Website and other resources and information, is for personal, non-commercial use only. All users are encouraged to make their own independent investigation and evaluation of any information posted on the Website. Any agreements regarding legal services or fees must be done outside the scope of the Website and are strictly between the user and the third party and do not involve Magic Lawyers in any way. Magic Lawyers is not a law firm. Magic Lawyers does not receive any portion of any attorney’s or law firm’s fees. Magic Lawyers is not involved in or responsible for any transactions that might occur, and does not guarantee the occurrence of such transactions. The user is solely responsible for compliance with all applicable laws, rules, and regulations.

4. Communications made to Third Parties by means of this Website
The user acknowledges that any information sent by the user to third parties by means of the Website (e.g. through a “share this page”) whether by email or otherwise, are not of a private nature. Such communication can be read by third parties without the user’s knowledge. The user agrees that content of any communication sent to third parties by means of the Website shall be non-confidential and non-proprietary. Magic Lawyers reserves the right of use of such communication for any purpose.

5. Prohibited Uses
The user warrants that the Website will not be used for any of the following:
a. Upload or transmission of content that violates privacy, intellectual property, or other proprietary rights of any third party;
b. Transmission of viruses, Trojan horses, worms, malicious code, or other harmful or destructive content/or any other content that is harmful or destructive;
c. Violation of this agreement, the Privacy Policy, or any applicable law or regulation, including but not limited to laws designed to regulate unsolicited email or other advertising;
d. Harming the goodwill or standing of Magic Lawyers or any of its clients, partners, employees, affiliates, agents, contractors, or representatives;
e. Probing, scanning, testing or violation of the security features of the Website or of any associated system or network, or to obtain unauthorized access to materials or other information stored thereon;
f. Interference or attempt of interference with the use of the Website by any other user.
Magic Lawyers reserves the right to full cooperation in any investigation by law enforcement officials of any violation of this Agreement or Privacy Policy.

6. Third-Party Websites
The Website may contain links to websites that are operated by third parties (“Third Party Websites”). Magic Lawyers has no control over Third-Party Websites, each of which may be governed by its own terms and conditions, terms of use, or privacy policy. Magic Lawyers has not reviewed, and cannot review, Third-Party Websites, and therefore does not warrant or endorse any Third-Party Website or the content appearing thereon. By visiting or using Third-Party Websites, the user assumes all responsibility and liability for all resulting harms, whether to the user or the third party, including but not limited to the user’s download or use of any content, software or other materials available on the Third-Party Website.

7. Consent to Receive Emails from Magic Lawyer
By agreeing to receive communication from Magic Lawyers on the Website, the user consents to receive emails sent by Magic Lawyers for dissemination of information to the email address provided on such subscription. If the user would like to stop receiving such emails, the user should click on the opt-out link contained in any of the emails sent to the user by Magic Lawyers.

8. Intellectual Property
The content located on the Website, including but not limited to this Agreement, is the copyrighted property of Magic Lawyers or its licensors. The Magic Lawyers name, magiclawyers.com domain name, and all other names and logos used by Magic Lawyers in connection with the offerings of Magic Lawyers’ goods and services are the trademarks and service marks, or registered trademarks, or registered service marks, of Magic Lawyers and/or its licensors. Neither the use of the Website not the Agreement grants the user any right, title or interest in or to Magic Lawyers and Magic Lawyers’ licensors’ copyrights, trademarks and service marks, except when this has been explicitly permitted by Magic Lawyers. By providing any content to the Website, the user agrees to grant Magic Lawyers a worldwide, royalty-free, perpetual, non-exclusive right and license, including any moral rights or other necessary rights, for the use of the content in the manner mutually agreed upon by the user and Magic Lawyers.
The user warrants and represents that the user has all legal, moral, and other rights that may be necessary to grant Magic Lawyers with the license set forth in this Section.
The user acknowledges and agrees that Magic Lawyers shall have the right (but not the obligation), in Magic Lawyers’ sole discretion, to refuse to publish or to remove or block access to any content the user provides, at any time and for any reason, with or without notice.
No compensation will be paid with respect to the content that the user submits to Magic Lawyers, unless otherwise agreed upon.

9. Payment
While many of the services offered on the Website are provided free of charge, some services require payment. The user must select a payment method and provide accurate billing and payment information when prompted to use the services that have fees associated with them. The user agrees to pay Magic Lawyers for all charges incurred under the users account, including all applicable taxes, fees and surcharges. The user authorizes Magic Lawyers to charge the designated payment method for such charges. If for any reason, Magic Lawyers does not receive payment from the designated payment method, the user agrees to pay all amounts due upon demand by Magic Lawyers or its operators. Every time the user uses the site, the user reaffirms that
a. Magic Lawyers (or its designated vendor acting as its billing agent) is authorized to charge the designated payment method;
b. Magic Lawyers may submit charges incurred under the account for payment; and
c. The user will be responsible for such charges.
The user agrees to be bound by the payment policies of the payment avenue (CC Avenue) being used by Magic Lawyers in order to make such payments.

10. Subscriptions
Details of subscriptions made available by Magic Lawyers are available in the pricing policy document available on the Website. By this reference, the Pricing Policy document will be considered to be a part of this Agreement, when such services are availed.

11. Liability
Magic Lawyers hereby gives formal notice that any person found to be guilty of any abuse of the Website is liable to be pursued for any damage caused, and furthermore any damage caused to the intellectual property rights of Magic Lawyers.
Magic Lawyers makes no representation or endorsement of the quality and services supplied by companies or firms that may be found on the Website. In no event will Magic Lawyers be liable for any damages including, but not limited to, indirect or consequential damages, or any damages whatsoever arising from use or loss of use, data, or profits, whether in action of contract, negligence or other tort action, arising out of or in connection with the use of the Website.

12. Indemnity
The user agrees to defend, indemnify, and hold harmless Magic Lawyers and its partners, employees, affiliates, agents, contractors, and representatives (the “Magic Lawyers Parties”) from and against all claims, losses, costs, damages, liabilities, and expenses (including, but not limited to, attorneys’ fees) arising out of or relating to:
i) Use of Website by the user;
ii) Any violation of the Agreement by the user; or
iii) User’s submission of incomplete, inaccurate or untimely information or other data to Magic Lawyers by means of the Website.
The Magic Lawyer Parties shall have the right, but not the obligation, to participate through counsel of their choice in any defense by the user under this Section.

13. Limitation of Warranties
By using the Website, the user understands and agrees that all resources provided by Magic Lawyers are “as in” and “as available”. This means that Magic Lawyers does not represent or warrant to the user that:
a. The use of Magic Lawyers’ resources will meet the user’s needs or requirements;
b. The use of Magic Lawyers’ resources will be uninterrupted, timely, secure, or free from errors;
c. The information obtained by using Magic Lawyers’ resources will be accurate or reliable; and
d. Any defects in the operation or functionality of any resources provided by Magic Lawyers will be repaired or corrected.
Further, the user understands and agrees that:
e. Any content downloaded or otherwise obtained through the use of Magic Lawyers’ resources is done at the user’s own discretion and risk, and that the user is solely responsible for any damage to the user’s computer or other devices for any loss of data that may result from the download of such content.
f. No information or advice, whether expressed, implied, oral or written, obtained by the user from the Website or through any resources provided by Magic Lawyers shall create any warranty, guarantee, or condition of any kind, except for those expressly outlined in the Agreement.

14. Termination
The user agrees that Magic Lawyers may, at Magic Lawyers’ sole discretion, suspend or terminate the user’s access to or part of the Website and resources with or without notice and for any reason, including but not limited to breach of the Agreement. Any suspected illegal, fraudulent or abusive activity may be grounds for terminating the user’s relationship and may be referred to appropriate law enforcement authorities. Upon suspension or termination, the user’s right to use the Website will immediately cease.

15. Privacy
Magic Lawyers’ Privacy Policy applies to use of the Website, and its terms are made a part of these Terms and Conditions by using this reference. Additionally, by using the Website, the user acknowledges and agrees that internet transmissions are never entirely private or secure. The user understands that any message or information that the user sends to the Website may be read or intercepted by others, even if there is a special notice that a particular transmission (e.g. credit card information) is encrypted.

16. Choice of Law; Jurisdiction and Venue
The Website is located and operated by Magic Lawyers in New Delhi, India. This enforcement and execution of this Agreement shall be as though in New Delhi, India, and shall be governed by and construed in accordance with the laws of the Republic of India without regard to its conflict of law principles. The proper venue for any judicial action arising out of or relating to the Website or this Agreement will be the appropriate law enforcement agencies. . The user hereby stipulates to, and agrees to waive any objection to, the personal jurisdiction and venue of such courts, and further expressly submits to extraterritorial service of process.

17. Entire Agreement; Amendment
This Agreement constitutes the entire agreement between Magic Lawyers and the user concerning the user’s use of the Website. This Agreement may only be modified as stated in Section 2, above, or by amendment signed by an authorized representative of Magic Lawyers.

18. Severability; Waiver
If any part of this Agreement is held invalid or unenforceable, that part will be construed to reflect the parties’ original intent, and the remaining portions will remain in full force and effect. A waiver by either party of any term of condition of this Agreement or any breach thereof, in any one instance, will not waive such term or condition or any subsequent breach thereof.

19. Assignment
The Agreement and all of the user’s rights and obligations hereunder will not be assignable to transferable by the user without the prior written consent of Magic Lawyers. Notwithstanding the foregoing, this Agreement will be binding upon and will enure to the benefit of the parties, their successors, and permitted assigns.

20. Relationship
Without limiting any other provision of this Agreement, this Agreement creates no agency, partnership, joint venture, or employee-employer relationship between the user and Magic Lawyers.
By using the Website, the user signifies their assent to these Terms and Conditions and any subsequent modifications. As a condition of the user’s use of the Website, the user warrants that the Website will not be used for any unlawful purpose.

Privacy Policy

Website Visitors
Magic Lawyers collects non-personally-identifying information provided by web browsers and servers, including but not limited to browser type, language preference, referring site, and the date and time of each visitor request. Magic Lawyers’ purpose in collecting non-personally identifying information is for better understanding of how the users use the Website.

Gathering of Personally-Identifying Information
Certain users may choose to interact with Magic Lawyers in ways that require Magic Lawyers to gather personally-identifying information. The amount and type of information gathered by Magic Lawyers depends on the nature of the interaction. Those who engage in such interaction are asked to provide additional information as necessary. In each case, Magic Lawyers collects such information only insofar as is necessary or appropriate to fulfill the purpose of the visitor’s interaction with Magic Lawyers. Magic Lawyers does not disclose personally-identifying information other than as described below. Users have the option to refuse to supply personally-identifying information, with caveat that it may prevent them from engaging in certain Website-related activities.

Protection of Certain Personally-Identifying Information
Magic Lawyers discloses potentially personally-identifying and personally-identifying information only to those of its employees, contractors and affiliated organizations that
i. Need to know that information in order to process on behalf of Magic Lawyers’
ii. Have agreed to not disclose it to others.
Magic Lawyers will not rent or sell potentially personally-identifying and personally-identifying information only in response to a subpoena, court order or other governmental request, or when Magic Lawyers believes in good faith that disclosure is reasonably necessary to protect the property or rights of Magic Lawyers, third parties or the public at large. Magic Lawyers takes all measures reasonably necessary to protect against the unauthorized access, use, alteration or destruction of potentially personally-identifying and personally-identifying information.

Changes to Privacy Policy
Magic Lawyers may, with sole discretion, change this Privacy Policy from time to time. Users are encouraged to periodically check this page for any changes to the Privacy Policy. Continued use of the Website after any change in the Privacy Policy will constitute acceptance of such change by the user.
